Selecta Klemm files for IP protection for Night Sky Patterned Petunias

Selecta says Westhoff’s Discoball spotted Petunia varieties infringe on two Selecta patents.


Selecta Klemm, per a statement released on Nov. 21, has filed for patent infringement in the United States District Court for the Eastern District of Texas. 

The complaint has been filed against German breeding company Westhoff, as well as unrooted cutting suppliers Vivero Internacional, Plant Source International and Cohen Propagation Nurseries. The complaint alleges that "importation of Westhoff’s Discoball spotted Petunia varieties into the United States infringes upon Selecta’s U.S. Patent Nos. 10,588,288 and 11,266,114 for their well-recognized and protected Sky Petunia pattern introduced into the market in 2016."
